Mr. Brett Tweedel recently secured the Louisiana Third Circuit Court of Appeal’s affirmation of the trial court’s dismissal of claims against his clients on summary judgment

Blue Williams Partner Mr. Brett Tweedel, who specializes in the areas of insurance defense and construction litigation, recently secured the Louisiana Third Circuit Court of Appeal’s affirmation of the trial court’s dismissal of claims against his clients on summary judgment.

The plaintiff sued after a trip and fall in a construction zone in the defendants’ custody. The plaintiff alleged that the defendants failed to warn passerby of hazards at the construction site. Mr. Tweedel secured summary judgment for the defendants because their work was performed in accordance with the plans and specifications provided to them, including the placement of all required construction signage and barricades. Any construction hazards would be considered open and obvious, absolving the defendants of any duty to further warn passersby.

The Louisiana Third Circuit Court of Appeals upheld the granting of the summary judgment.
