Following trial, the workers’ compensation court determined that the claim was reasonably disputed. As a result, the court rejected the claimant’s request for penalties and attorney’s fees and dismissed the case with prejudice, bringing the litigation to a favorable conclusion for Pope’s clients.

Under Louisiana workers’ compensation law, penalties and attorney’s fees may be sought when an employer or insurer allegedly fails to pay benefits appropriately. In this matter, the court found that the defendants had a reasonable basis for disputing the claim and declined to impose the requested penalties or fees.

The ruling reflects Pope’s experience defending employers and insurers in Louisiana workers’ compensation litigation, including disputes involving compensability, benefit payments, penalties, and attorney’s fees.
