Steve Mauterer, obtains full dismissal of all alleged constitutional claims brought against Sheriff and Deputy Sheriff
Blue Williams partner, Steve Mauterer, obtains full dismissal of all alleged constitutional claims brought against Sheriff and Deputy Sheriff by contractor investigated and arrested pursuant to arrest warrant following complaint by homeowner. While currently litigating a civil claim with a homeowner in state court, the contractor sued law enforcement in the Eastern District of Louisiana (Chad Melancon v. Bradley Walsh, et al, EDLA 23-7394) for doing their job; investigating complaints of criminal offenses and presenting arrest warrants supported by probable cause to a neutral Judge. Finding no constitutional violations for false arrest, malicious prosecution, and abuse of process, and if there were, the deputy entitled to Qualified Immunity, an Eastern District Court Judge granted the defense’s Motion to Dismiss and immediately rendered Judgment finding that any amendment would be futile.
